AMENDMENT No. 1 PROPOSED TO

Amend by striking all after the enacting clause and inserting in lieu thereof the following:
SECTION 1. Chapter 930, Local and Private Laws of 1994, is amended as follows:
Section 1. (1) Notwithstanding any provisions of Section 21-27-39, Mississippi Code of 1972, to the contrary, the governing authorities of the Town of State Line, in Greene and Wayne Counties, Mississippi, in their discretion, may construct, expand, operate and maintain the water distribution system of the Town of State Line for a distance not to exceed seventeen (17) miles from the corporate limits of the Town of State Line. Whenever such water utility service is furnished to any consumer residing outside the corporate limits of the Town of State Line, the consumer may not be charged at a rate greater than twice the rate charged for the same service within the corporate limits of the Town of State Line. Upon the completion of any construction, expansion or improvement of the water distribution system under authority of this act and the retirement of any and all indebtedness incurred by the system, the consumers of water service furnished by the system who reside outside the corporate limits of the Town of State Line shall be charged at the same rate as that charged to consumers who reside within the corporate limits of the town.
(2) The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a Certificate of Public Convenience and Necessity, the jurisdiction of the Public Service Commission to regulate rates or any other provisions of that law.
SECTION 2. This act shall take effect and be in force from and after its passage.
Further, amend by striking the title in its entirety and inserting in lieu thereof the following:
AN ACT TO AMEND CHAPTER 930, LOCAL AND PRIVATE LAWS OF 1994, TO INCREASE THE NUMBER OF MILES THAT THE TOWN OF STATE LINE, MISSISSIPPI, MAY EXPAND ITS WATER DISTRIBUTION SYSTEM OUTSIDE ITS CORPORATE LIMITS; AND FOR RELATED PURPOSES.
